Is this a welcome ruling or is this political persecution brought about by Duterte's opponents?

The Facts

  • Former Philippine President Rodrigo Duterte is fit to stand trial and face charges for crimes against humanity, the International Criminal Court (ICC) announced this week.
  • In a ruling that was made on Sept. 28 but made public on Thursday, the court said the decision was made based on lawyers' submissions and the findings of an independent panel of experts, adding that it was satisfied that Duterte, 81, was "able to effectively exercise his fair trial rights in the proceedings."
  • "The Expert Panel unanimously found that the Accused has the capacity to understand the charges, understand the purpose and consequences of the proceedings, follow the course of the proceedings, including the nature and implications of entering a plea, understand the evidence, and instruct counsel in the preparation and conduct of his defence," the statement read.

The Spin

Pro-establishment narrative

This ruling from the ICC is welcome and it is hoped that Duterte can stay fit for the duration of the trial so he can face justice for his "war on drugs" killings.

Establishment-critical narrative

The ICC probe into Duterte is compromised because the evidence it relies upon was provided by his political opponents. Additionally, the ICC prosecutor that brought the case had a conflict of interest as he previously represented the alleged victims in another case.
