Petrobras Strikes $58 Million Deal to Address Offshore Well Compliance

The Facts

Petrobras signed a settlement agreement with Brazil's National Agency of Petroleum, Natural Gas and Biofuels (ANP) on Tuesday to bring 335 temporarily abandoned offshore wells into compliance with safety and environmental rules.

The agreement, signed at the Attorney General's Office in Brasília, gives Petrobras until Dec. 31, 2030, to complete the adaptation of all 335 wells, including 76 whose management was transferred to other operators.

In a statement to Reuters, Petrobras said that it had already brought 233 of the 335 wells into compliance, with the remaining 102 to be addressed according to a schedule agreed upon with the ANP.

As part of the agreement, Petrobras will also pay R$300 million ($58.1 million) to the ANP, with R$105 million due within 30 days of final signing and the remaining R$195 million paid in 48 monthly installments adjusted by Brazil's benchmark Selic rate.

In addition, the ANP will gain 20-year access to a private international database of oil, rock and formation water analyses from various sedimentary basins, and Petrobras must also provide historical geochemical data collected since 1974.

Negotiations between the two lasted five years, with the conciliation process beginning in June 2021. The ANP board unanimously approved the settlement after determining that administrative fines alone would not guarantee compliance or eliminate associated risks.

Instead of slapping fines that would have achieved little, ANP locked in a concrete plan to fix 335 offshore wells by 2030, with real accountability, monitoring and compliance mechanisms built in. This deal, therefore, delivers the environmental protection that Brazil's coastline and littoral waters desperately need.

Fixing old wells means nothing when Petrobras is aggressively drilling new ones in one of the most ecologically fragile ocean frontiers on Earth. Despite Brazil's own environmental agency calling the spill risk inside the Equatorial Margin "unprecedented," and a leak occurring in January, the ANP has chosen to prioritize legacy problems over preventing future exploration.
