This settlement proves that no matter how big you are, if you rig hiring against U.S. workers, expect to face the consequences. OpenAI deliberately buried job postings, demanded paper applications and ran radio ads late at night to keep Americans from competing for top tech jobs. The DOJ, however, has now put a pin in that operation and delivered the fair recruitment that the American workforce deserves.
A $3.2 million fine is a slap on the wrist for a company worth hundreds of billions that gamed the PERM process to lock out American workers. Neither will it deter the next violation in an industry that has been pulling this trick for years. If the administration wants to see change, it's got to bring real punishments to the table, such as revoking access to foreign labor, in response to these violations.
