Brazil's tyrannical justice Alexandre de Moraes is now weaponizing defamation law to silence an elected congressman for a tweet questioning a colleague's donor ties, in a direct attack on political speech in the country. This should be no surprise, though, as the same judge is eyeing to boot Eduardo's brother, Sen. Flávio Bolsonaro, from the presidential ballot. This is judicial power being used to shape elections, not deliver justice.
Spreading lies about a fellow lawmaker's donor relationships is defamation, plain and damaging, not protected political speech. Justice Moraes got this right, and holding elected officials accountable to basic standards of honesty is exactly what a functioning democracy requires. Eduardo Bolsonaro's potential conviction will stress that politicians have no free pass to smear colleagues with false accusations.
