The Facts

  • Brazil's top electoral court temporarily barred presidential candidate Pablo Marçal from participating in debates and accessing public campaign funds, among other campaign activities, in a 7-0 vote on Thursday, pending a final decision on whether his candidacy is valid.
  • Electoral prosecutors filed their challenge asking for the court to reject his registration outright on Wednesday evening. Earlier that day, news broke that Marçal had sent a formal letter to TV channel Band requesting inclusion in its Sunday presidential debate.
  • This comes as Marçal said on Monday that he would take part in debates, implying that upcoming opinion polls would shake up the presidential race and show strength on his ticket. A Datafolha poll set to be released on Friday will be the first to include Marçal.

Barring Pablo Marçal from debates before his case is fully decided creates an uneven playing field. This is a blatant act of censorship that punishes a candidate even before guilt is confirmed. If his candidacy is ultimately validated, the damage to his campaign will already be done, since momentum, exposure, and public trust don't come back once they're gone. Courts should refrain from deciding winners and losers through procedure before voters get the chance to decide for themselves.

Marçal launched a candidacy despite being ruled ineligible until 2032, which makes these restrictions entirely justified. His campaign is built on spectacle, disinformation and attacks on the institutions meant to hold him accountable. Marçal was never a real candidate: he's Flávio Bolsonaro's designated spoiler, sent to bleed attention and votes from center-right rivals while doing the dirty attacks Flávio won't. It's positive that electoral authorities are taking swift action.
