Illinois Gov. J.B. Pritzker signed SB 315, the Artificial Intelligence Safety Measures Act, into law on Monday, making Illinois the first state to require annual independent third-party safety audits of advanced AI systems developed by companies with more than $500 million in annual revenue.

The law, which takes effect Jan. 1, 2027, passed the state legislature with bipartisan support and received endorsements from AI firms, including OpenAI and Anthropic, which publicly backed the bill before it cleared the general assembly in May.

It requires large frontier developers to develop and publish a "frontier AI framework" — which it must update annually — detailing how it intends to manage "catastrophic risks," defined as a frontier model that can contribute to the death of or serious injury to more than 50 people, or cause more than $1 billion in property damage, from a single incident.

Thereafter, beginning on Jan. 1, 2028, these developers must retain third-party auditors, free of any financial conflicts of interest, to review their processes and levels of compliance with their framework and write a report that the developers must publish on their website within 30 days of receiving it.

In addition, SB 315 requires large frontier AI developers to report critical safety incidents within 72 hours — or 24 hours if judged to pose an imminent risk of death or serious physical injury — and establish whistleblower protections for employees who raise AI safety concerns.

Violations of the law — which drew on inspiration from similar frameworks previously enacted in California and New York — can result in civil penalties of up to $1 million for a first offense and $3 million for subsequent offenses.

Illinois just set the gold standard for AI accountability by becoming the first state to require independent third-party safety audits of powerful AI systems. With the federal government sitting on its hands, states have to step up, and SB 315 does exactly that by requiring Big Tech to be transparent about the risks it may be developing rather than just asking nicely.

SB 315's mandatory audit requirement is built on a foundation that doesn't exist, with no recognized certification standards, qualified auditors or defined methodology for frontier model safety compliance. Forcing companies to meet these undefined obligations will not protect consumers, but it will create massive legal exposure and drive AI investment out of Illinois.
