Is this a victory for free speech or a free pass for pollsters who get it badly wrong?

Anti-Trump narrative
This is a win for every American who publishes something a politician doesn't like. Polling is social science, not fortune telling, and a missed number can't be twisted into consumer fraud without gutting the First Amendment. Suits like this exist to drain critics with legal bills until silence feels cheaper than speech.
Pro-Trump narrative
A poll off by double digits days before an election is a thumb on the scale that shapes how people vote and donate. Pollsters sell their work as reliable data, and when the product is that far from reality, there should be serious consequences. Hopefully pollsters will eventually be held accountable in court.
