Is this a clear-cut case of defamation or lawfare from a streamer who can't clear the actual malice bar?

The Facts

  • Twitch streamer Hasan Piker filed a $72.5 million defamation lawsuit Tuesday in federal court in Washington, D.C., against conservative commentator Scott Jennings, alleging Jennings falsely claimed Piker advocated the lynching of Black Americans.
  • The complaint brings claims of defamation per se, defamation by implication and false light. Piker seeks at least $27.5 million in compensatory damages and $45 million in punitive damages.
  • The suit centers on an Aug. 11 episode of "The Scott Jennings Show," in which Jennings told listeners that Piker was "out there calling for Black voters to be lynched" and referred to a "plan of returning our country to lynchings."

The Spin

Narrative A

This is about as clear-cut a case as defamation gets. Piker's original bit was a mockery of a conservative's talking point, chopped up until the meaning flipped. A massive payout is the only consequence right-wing media ever seems to feel so Piker should prevail in the end.

Narrative B

Running to court over a disputed clip is lawfare from a socialist streamer who got rich off the very system he's now wielding as a weapon. Public figures have to prove actual malice, and posting a viral clip with commentary nowhere near clears that bar. Piker's inflammatory reputation isn't suddenly worth tens of millions because a pundit weighed in.
