EU to Provisionally Implement Mercosur Trade Deal Amid Legal Review

European Commission President Ursula von der Leyen announced on Friday that the EU will provisionally apply its trade agreement with Mercosur, adding that the European Council in January allowed the Commission to do so following the first ratification by a Mercosur country.

This comes as the EU Parliament last month decided to refer the deal to the European Court of Justice for a legal assessment, following a 334-324 vote, potentially delaying full ratification and implementation by 18 to 24 months.

French President Emmanuel Macron called the unilateral decision a "bad surprise" for his country and disrespectful toward the EU Parliament. According to Euractiv, France pushed for an EU Council declaration to block the move but Cyprus — the current presidency holder — abandoned the text.

EU Commission spokesman Olof Gill said that the provisional application may start within two months, as Uruguay and Argentina ratified the agreement on Thursday. Uruguay saw a 91-2 vote in the lower house after unanimous approval in the Senate, while Argentina saw a 69-3 vote in the Senate after a 203-42 vote in the lower house.

Brazil's lower house of Congress approved the agreement in a symbolic vote on Wednesday, moving the text to the Senate for final endorsement. Meanwhile, lawmakers in Paraguay are expected to vote on ratification in early March.

Signed in Paraguay earlier this year following 25 years of negotiations, the EU-Mercosur Partnership Agreement and Interim Trade Agreement aim to gradually eliminate tariffs on around 91% of trade between the blocs and create a free trade area with more than 700 million consumers.
